Terms of Service

1. Candidate Agreement

1. Purpose

This Candidate Agreement applies to all healthcare professionals who register with TSOR Med to obtain temporary, contract, sessional, or locum work through the Platform.

By registering, applying for shifts, or accepting Bookings, you agree to comply with this Agreement.

2. Eligibility

To use the Platform as a Candidate, you must:

  • Be at least 18 years old.
  • Have the legal right to work in the United Kingdom.
  • Hold current registration with your applicable professional regulator.
  • Meet all statutory and professional requirements for the roles you accept.
  • Provide accurate and complete information during registration and throughout your use of the Platform.

3. Professional Responsibilities

Candidates agree to:

  • Practise only within their competence.
  • Comply with professional codes of conduct issued by their regulator.
  • Maintain valid registration and licences.
  • Keep mandatory training up to date.
  • Maintain professional indemnity insurance where required.
  • Notify TSOR Med promptly of any changes affecting their eligibility to practise.

4. Availability and Bookings

Candidates are responsible for:

  • Keeping their availability accurate.
  • Accepting only shifts they intend to work.
  • Arriving on time and prepared for each Booking.
  • Informing the Client and TSOR Med immediately if unable to attend.

Repeated cancellations or no-shows may result in suspension or removal from the Platform.

5. Timesheets

Candidates must:

  • Submit accurate timesheets within the timeframe specified by the Client or Platform.
  • Ensure hours claimed accurately reflect hours worked.
  • Cooperate with any audit or investigation into submitted timesheets.

Submitting false timesheets may result in termination of access and referral to relevant authorities or professional regulators.

6. Confidentiality

Candidates must:

  • Protect patient confidentiality.
  • Keep Client information secure.
  • Not disclose confidential information except where authorised or required by law.
  • Return or securely destroy confidential documents when no longer required.

7. Conduct

Candidates must not:

  • Work while impaired by drugs or alcohol.
  • Engage in discrimination, harassment, bullying or abusive behaviour.
  • Falsify qualifications or documentation.
  • Share Platform login credentials.
  • Misrepresent their professional experience or competencies.

8. Taxes and Employment Status

Unless expressly agreed otherwise:

  • Candidates are responsible for their own tax affairs, National Insurance contributions, pensions, and other statutory obligations.
  • Registration with TSOR Med does not create an employment relationship between the Candidate and TSOR Med.

9. Suspension and Termination

TSOR Med may suspend or terminate a Candidate's account where there is a breach of this Agreement, failure to maintain compliance, suspected fraud, or concerns regarding patient safety.

2. Employer Agreement

1. Purpose

This Agreement applies to healthcare organisations using TSOR Med to source temporary healthcare professionals.

2. Responsibilities

Employers agree to:

  • Provide accurate shift details.
  • Ensure a safe working environment.
  • Treat Candidates fairly and respectfully.
  • Provide any necessary induction or orientation.
  • Comply with all applicable employment, health and safety, equality, and healthcare legislation.

3. Shift Information

Each shift listing should include:

  • Location.
  • Dates and times.
  • Duties.
  • Required qualifications.
  • Rate of pay.
  • Clinical systems used (where relevant).
  • Any mandatory training or equipment requirements.

4. Timesheet Approval

Employers should approve or dispute submitted timesheets promptly.

Failure to respond within the specified period may result in automatic approval where permitted by the Platform.

5. Payment

Employers agree to pay:

  • Candidate remuneration.
  • Platform fees.
  • Applicable taxes.
  • Any agreed cancellation or late payment charges.

6. Cancellation

Employers should provide as much notice as possible when cancelling Bookings.

Repeated cancellations without reasonable justification may result in restrictions, charges, or suspension.

7. Feedback

Employers may provide ratings and reviews that are accurate, objective, and based on genuine experiences.

Reviews must not include confidential patient information or discriminatory content.

8. Compliance

Employers remain responsible for:

  • Clinical governance.
  • Patient safety.
  • Safe staffing.
  • Compliance with Care Quality Commission (CQC) requirements where applicable.

9. Suspension

TSOR Med may suspend or terminate Employer accounts where there is fraud, misuse of the Platform, repeated payment failures, or significant breaches of this Agreement.

3. Payment & Refund Policy

1. Payment Processing

All payments for Bookings must be processed through the Platform unless otherwise agreed in writing.

Payments may be facilitated by regulated third-party payment providers.

2. Candidate Payments

Subject to approved timesheets, Candidates will normally receive payment within the published payment timeframe.

Payment timing may vary due to banking processes, weekends, public holidays, or compliance checks.

3. Employer Payments

Employers authorise TSOR Med to collect all charges relating to confirmed Bookings, including:

  • Candidate fees.
  • Platform fees.
  • Payment processing charges.
  • Applicable taxes.

4. Refunds

Refund requests may be considered where:

  • A Booking is cancelled in accordance with Platform policies.
  • Duplicate payments have been made.
  • A technical error has resulted in an incorrect charge.
  • Services were not provided due to verified Platform error.

Refunds will not normally be issued for:

  • Completed Bookings.
  • Dissatisfaction with a Candidate where services were substantially delivered.
  • Failure to attend where cancellation policies apply.

5. Disputed Payments

Where a payment is disputed:

  • Funds may be temporarily withheld.
  • Additional information may be requested from both parties.
  • TSOR Med will review available evidence before determining whether payment should proceed.

6. Chargebacks

Where an Employer initiates a payment chargeback without reasonable grounds, TSOR Med may:

  • Suspend the account.
  • Recover outstanding amounts.
  • Offset future payments.
  • Recover associated costs where legally permitted.

7. Late Payments

Late payments may be subject to:

  • Interest where permitted by law.
  • Administrative charges.
  • Temporary suspension of Platform access.
  • Debt recovery proceedings.

4. Verification & Compliance Policy

1. Purpose

This Policy explains how TSOR Med verifies healthcare professionals and healthcare organisations to support compliance, reduce fraud, and promote patient safety.

2. Candidate Verification

Candidates may be required to provide:

  • Government-issued photographic identification.
  • Proof of address.
  • Professional registration details.
  • Qualifications.
  • Employment history.
  • References.
  • Right-to-work documentation.
  • DBS certificates where applicable.
  • Professional indemnity insurance.
  • Mandatory training certificates.
  • Occupational health documentation where required.

Verification may be repeated periodically or where circumstances change.

3. Professional Registration Checks

TSOR Med may verify registration with the relevant regulatory body, including:

  • General Medical Council (GMC).
  • General Pharmaceutical Council (GPhC).
  • Nursing and Midwifery Council (NMC).
  • General Dental Council (GDC).
  • Health and Care Professions Council (HCPC).
  • Pharmaceutical Society of Northern Ireland (PSNI).
  • General Optical Council (GOC).

Public registers and authorised verification providers may be used.

4. Right-to-Work Verification

TSOR Med may verify eligibility to work in the United Kingdom by reviewing:

  • Passports.
  • Visas.
  • Home Office share codes.
  • Biometric residence permits.
  • Other lawful evidence of immigration status.

5. DBS Checks

Where required for the role, Candidates may need to provide evidence of:

  • Basic DBS.
  • Standard DBS.
  • Enhanced DBS.
  • Enhanced DBS with Barred Lists.

The level required depends on the duties to be undertaken.

6. Employer Verification

Healthcare organisations may be required to provide:

  • Company registration details.
  • CQC registration where applicable.
  • Practice or pharmacy registration details.
  • Proof of trading address.
  • Details of authorised representatives.
  • Billing information.

7. Ongoing Compliance

Users must promptly notify TSOR Med of any material changes, including:

  • Expired professional registration.
  • Restrictions on practice.
  • Changes to immigration status.
  • Criminal convictions where relevant.
  • Loss of required insurance.
  • Changes affecting eligibility to undertake healthcare work.

8. Fraud Prevention

TSOR Med may use manual and automated measures to detect and investigate:

  • False identities.
  • Fraudulent documentation.
  • Misrepresentation of qualifications.
  • Duplicate accounts.
  • Unusual payment activity.
  • Other suspected fraudulent or unlawful behaviour.

Suspected fraud may result in suspension, termination, and referral to relevant authorities or professional regulators where appropriate.
